Welcome to GRSOFT Structural Engineering! By accessing or using our website and structural engineering design services (“services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please refrain from using our services.

Use of Services

You may use GRSOFT Structural Engineering services solely for lawful purposes and in accordance with these Terms. By engaging our services, you agree to:

  • Provide accurate and complete project details.

  • Use the project documentation and designs strictly for their intended purposes and specified projects.

  • Ensure compliance with all applicable building codes, laws, and regulations

Eligibility

To use our structural engineering design services, you must:

  • Be of legal age and capable of entering into a binding agreement in your jurisdiction.

  • Possess the authority to engage GRSOFT on behalf of an organization, if applicable.

To use our software, you must be of legal age and capable of entering into a legally binding agreement in your jurisdiction.

Scope of Services

GRSOFT provides professional structural engineering design services, including:

  • Preparation of detailed project documentation.

  • Compliance with relevant building codes and standards.

  • Coordination with project stakeholders, if necessary.

All services are based on the information provided by the client. Any deviation or additional requirements may result in revised timelines and additional charges. 

Prohibited Activities

When using our services, you agree not to:

  • Submit Inaccurate Information: Provide false or incomplete project details.

  • Misuse Documentation: Alter, share, or distribute project documentation without prior consent.

  • Repurpose Designs: Use designs or documentation for projects other than those explicitly agreed upon.

  • Bypass Security Measures: Attempt to breach any technical safeguards in place.

  • Violate Intellectual Property Rights: Use GRSOFT materials without authorization.

Client Responsibilities

To ensure smooth execution of services, clients are responsible for:

  1. Accurate Information: Providing detailed and accurate project requirements.

  2. Timely Communication: Responding promptly to queries and reviewing deliverables.

  3. Compliance with Regulations: Ensuring that the project complies with local, regional, and national building codes. GRSOFT shall not be liable for non-compliance resulting from incorrect or incomplete information provided by the client.

  4. Review and Approval: Reviewing all deliverables within the agreed timeframe and notifying GRSOFT of any discrepancies or required adjustments.

Adherence to Quality Code and Code of Ethics

GRSOFT Structural Engineering adheres to the principles of the Quality Code and Code of Ethics of the Slovenian Chamber of Engineers (Inženirska zbornica Slovenije, IZS). These principles include:

  1. Commitment to Public and Client Interests: Engineers are committed to improving quality of life, protecting public interests, and safeguarding individual rights.

  2. Professional Responsibility: Engineers ensure the proper functioning of everyday processes and contribute to general welfare, environmental protection, technological progress, and sustainable development.

  3. Ethical Standards: High ethical and moral norms guide all professional activities, ensuring the highest quality of engineering services.

  4. Transparency and Confidentiality: Engineers respect client confidentiality, ensuring that project data is not disclosed without proper consent or legal requirements.

  5. Qualifications and Competence: Services are provided only within the scope of the engineer’s qualifications and authorizations.

  6. Fair Competition: Advertising and pricing of services are transparent, not misleading, and aligned with industry standards to ensure fair competition.

  7. Professional Development: Engineers continually enhance their knowledge and mentor younger colleagues to foster professional growth.

Violations of these principles are subject to disciplinary actions as outlined by the IZS.

Service Availability

While we strive to meet agreed project timelines, GRSOFT does not guarantee uninterrupted availability of services. Delays may occur due to unforeseen circumstances or additional information requests from the client.

Intellectual Property

All designs, calculations, and project documentation provided by GRSOFT remain the intellectual property of GRSOFT unless otherwise agreed in writing. Clients are granted a limited, non-transferable license to use the deliverables solely for the specified project.

Third-Party Collaboration

GRSOFT may collaborate with third-party professionals (e.g., architects or contractors) at the client’s request. However, GRSOFT is not responsible for the accuracy, timeliness, or quality of services provided by third parties.

Warranties and Disclaimers

GRSOFT’s services are provided “AS IS,” without any warranties, expressed or implied. We disclaim all warranties of any kind, including but not limited to:

  • Fitness for a Particular Purpose: No guarantees are provided that the deliverables will meet expectations beyond the agreed project scope.

  • Non-Infringement: Deliverables will not infringe on third-party rights.

GRSOFT is not liable for errors arising from incomplete or inaccurate information provided by the client.

Limitation of Liability

To the extent permitted by law, GRSOFT shall not be liable for:

  • Indirect, incidental, or consequential damages.

  • Project delays caused by third parties or unforeseen circumstances.

  • Damages resulting from the misuse or alteration of project documentation.

In jurisdictions where liability limitations are restricted, GRSOFT’s liability is limited to the value of the services rendered.

Indemnification

You agree to indemnify and hold harmless GRSOFT, its affiliates, and employees from any claims, losses, or damages arising from:

  • Your failure to comply with applicable laws or building codes.

  • Misuse of the provided designs or documentation.

  • Breach of these Terms.

Termination

GRSOFT reserves the right to terminate services at any time if these Terms are violated. Upon termination, all project documentation must be returned to GRSOFT, and further use of the deliverables is prohibited.

Governing Law and Dispute Resolution

These Terms and any disputes arising from our services shall be governed by the laws of Slovenia/EU. Any legal proceedings shall be exclusively conducted in the courts located in Slovenia/Ljubljana.

Changes to These Terms

GRSOFT reserves the right to update these Terms at any time. Changes will be effective immediately upon posting the revised Terms on our website. Clients are encouraged to review these Terms periodically.
